Student Enrollment Agreement    

Thank you for choosing Gracie Jiu-Jitsu East San Jose ! We pride ourselves in providing the safest and most structured learning opportunity in all of Brazilian Jiu-Jitsu, and we are very excited to have you join the family. Please review and acknowledge the following so we can get you started on the Gracie Jiu-Jitsu journey. 

I, THE STUDENT OR THE PARENT ON BEHALF OF THE STUDENT, UNDERSTAND that under the terms of this agreement, the school obligates itself to furnish me/my child with competent instruction and suitable facilities for teaching lessons. All class lessons are supervised by qualified personnel trained in the procedures and traditions of Gracie University. I agree that I/my child is physically fit to receive and participate in the prescribed course of instruction. I agree to faithfully comply with all the rules and regulations of Gracie Jiu-Jitsu East San Jose . The regular hourly tuition is $50 per hour; however, a substantial discount has been provided to me by enrolling in a training program.

10-DAY FREE TRIAL: I understand that I will be granted free unlimited access to classes in the prescribed program(s) at Gracie Jiu-Jitsu East San Jose for 10 calendar days in order to determine if I want to continue with a paid membership. During the 10-day free trial period, I have the right to cancel this agreement for any reason. Cancellation must be submitted using the official Trial Period Cancellation Form provided by Gracie Jiu-Jitsu East San Jose . Verbal, email, written, or text message requests for cancellation will not be honored. 

MONTHLY PAYMENTS: I understand that if I enroll in a paid membership after the 10-day free trial that my/my child's tuition payments will be made in monthly installments, and Gracie Jiu-Jitsu East San Jose has a fiduciary responsibility to collect all payments in a timely manner. Any modifications, changes, amendments, or cancellations of this agreement must be in writing. 

60-DAY CANCELLATION POLICY: I understand that if I enroll in paid membership after the 10-day free trial, I have the right to cancel this agreement for any reason with a 60-day notice using the official 60-Day Notice of Membership Cancellation form provided by Gracie Jiu-Jitsu East San Jose . Any other verbal, email, written, or text message requests for cancellation will not be honored. I understand that I am authorized to train during the 60-day cancellation period in accordance with the terms of my membership agreement. All monthly tuition payments are due until proper cancellation procedures have been followed. In no case shall any monthly payment be retroactively refunded.

NO ROLLOVER CLASSES: I understand that the budgeted tuition payment plan is not affected by my/my child's training schedule and/or attendance. I am aware that any unused classes within my/my child's current billing cycle will not roll over to the next cycle, nor will I be entitled to a credit for these unused classes. Gracie Jiu-Jitsu East San Jose will automatically charge my billing method the discounted rate of $30 (compared to $40 regular drop-in fee) for each class over my monthly limit. 

FREEZE FEE: I understand there is a maximum pause ("freeze") in monthly payments of two (2) months per twelve-month period. If I wish to freeze my membership, a fee of $25 will automatically apply for each month the account is frozen. I understand that I will have access to the online Gracie University video curriculum during the period for which my membership is frozen.

INJURY POLICIES: I understand that if I/my child becomes injured or disabled for at least three (3) months during the membership period and the injury is confirmed in writing by a physician, I have a right to a freeze the account at no cost or cancel the agreement altogether with a 30-day written notice. 

RESPECT & SAFETY: I understand that belt promotions or other indication of rank is a privilege and not a right. My/my child's acceptance of instruction from Gracie Jiu-Jitsu East San Jose constitutes acknowledgment that I shall treat the students and the facilities with the utmost respect. If at any point, my/my child's behavior is deemed to be unsafe or disrespectful, Gracie Jiu-Jitsu East San Jose reserves the right to cancel this agreement and terminate the membership. I shall be entitled to a refund of all unearned amounts due upon cancellation by Gracie Jiu-Jitsu East San Jose . 

SCHOOL CLOSURES: Gracie Jiu-Jitsu East San Jose administrators may make any modifications to the class schedule as deemed necessary. Such modification does not relieve me of my payment obligations under any circumstances. School administrators also reserve the right to close the school on national holidays, for special events, and for a cumulative period of four weeks per calendar year for necessary maintenance and other purposes without affecting scheduled tuition payments. If the school is closed for more than four weeks, you are entitled to cancel this agreement. 

DOWNGRADE FEE: I understand that if I wish to change my/my child's training program to one of lesser value there will be a $25 downgrade fee applied automatically using the form of payment on file. If I upgrade my/my child's membership to one of higher value, there will be no charge. 

LATE CHARGE: I understand that a fee of twenty dollars ($20.00) will be assessed for any payments ten (10) days past due. 

DEFAULT PAYMENTS: I assume all responsibility for all costs related to account collections, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees, administrative fees and applicable late charges that may be incurred for default payments.

FAMILY MEMBERSHIP DISCOUNTS: Gracie Jiu-Jitsu East San Jose offers a family membership discount program for members who reside at the same billing address and share one billing account. Under this program, the main membership is priced at full price, while the second membership receives a 20% monthly discount and any additional membership receives a 30% monthly discount. The highest-price membership is considered the main membership and the lower-priced memberships receive subsequent discounts in decremental order of price. If any membership within the family changes, such as upgrading, downgrading, or canceling, or a new family member is added, the family membership pricing will be recalculated. Please note that changes to the family membership pricing structure will be communicated to the main account holder via email. It is important to understand that any such changes will not result in the voiding or termination of the membership agreement.

BY ENTERING INTO THE AGREEMENT I grant the school permission to use photographs, videotapes, artwork or other likenesses of me/my child (the student) for marketing, trade, publishing, or any other lawful purpose, without compensation.

MEMBERSHIP IS non-transferable except as stated herein.

I AUTHORIZE the use of a disclosed e-mail address for billing purposes and acknowledge that e-mail correspondence may include financial information pertaining to the membership.

I understand that I have the option to cancel my free trial anytime during the 10-day period, and if I choose not to cancel, my membership program and the related tuition payments will begin automatically according to the following details:

If my 10-day free trial period ends without cancellation, I promise to pay the equal monthly installments of {membership_fees}  with the first monthly installment being due on {start_date} and all subsequent installments being due the same (or next closest) day of each consecutive month to be paid directly to Gracie Jiu-Jitsu East San Jose . If, in a given installment period, I participate in more classes than what is included in the training program I have selected, I understand that I will be automatically charged the discounted rate of $30 for each additional class using the form of payment on file. I understand that I may cancel my membership at any time by following the 60-day cancellation procedures outlined herein.

I have read and understood all the terms and conditions set forth herein and understand that any electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.

WAIVER / RELEASE / ASSUMPTION OF RISK

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

In this waiver, the term "Participant" refers to the individual engaged in martial arts activities provided by Gracie Jiu-Jitsu East San Jose . The "Signer" is defined as the individual who acknowledges and agrees to the terms of this waiver. For Participants under the age of 18, the Signer must be their legal guardian or parent. If the Participant is 18 years of age or older, they are required to be the Signer of this waiver themselves, thereby accepting all terms and conditions herein.

Your participation in any of the martial arts-related activities (hereinafter “Gracie Jiu-Jitsu” or the “Activities”) offered by or in connection with Gracie Jiu-Jitsu East San Jose is expressly conditioned upon your acceptance of the terms of this agreement. If, for any reason, you do not agree to the terms and conditions expressed herein, Signer should not sign this agreement, and Participant should not participate in any of the Activities.

PLEASE READ THE FOLLOWING CAREFULLY BEFORE DECIDING TO PARTICIPATE.

I understand that the martial art known as "Gracie Jiu-Jitsu" is taught using precautions to avoid any injuries. However, it may entail some risk of accident or injury and that this may be serious or even mortal as a consequence of the practice. Along with the possibility of personal injury, injury to property is also possible, including but not limited to, possible loss of wages and the ability to earn such wages.

The practice of Gracie Jiu-Jitsu presents a risk of skin infections, MRSA, transmittable diseases, bacteria(s) and viruses, including, but not limited to, COVID-19. Participant shall not attend Gracie Jiu-Jitsu classes if Participant diagnosed with COVID-19 or if Participant is in close contact with someone diagnosed with COVID-19. Further, if Participant is displaying symptoms of COVID-19, or if Participant is in close contact with someone who is displaying symptoms of COVID-19, Participant shall not attend Gracie Jiu-Jitsu classes. Symptoms of COVID-19 can range from mild illness to pneumonia, including fever, respiratory symptoms such as coughing, sore throat and/or shortness of breath, and other symptoms such as a runny nose, headache, muscle or joint pains, nausea, diarrhea, vomiting, loss of sense of smell, altered sense of taste, loss of appetite and fatigue. If Participant is displaying these symptoms when in attendance at Gracie Jiu-Jitsu classes, I acknowledge that Participant may be asked to leave.

I agree that Participant will not participate in the Activities unless Participant is medically able and properly trained, and I agree to abide by the decision of Gracie Jiu-Jitsu East San Jose official or agent, regarding Participant's approval to participate in the Activities.

PARTICIPANT IS  VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITIES AND PARTICIPANT IS PARTICIPATING IN THE ACTIVITIES ENTIRELY AT THEIR OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THESE ACTIVITIES, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVITIES, OR FROM CONDITIONS AT THE LOCATION(S) OF THE ACTIVITIES. NONETHELESS, PARTICIPANT ASSUMES ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF PARTICIPANTS' PARTICIPATION IN THESE ACTIVITIES.

With full knowledge of the aforementioned dangers, both to participant's person and to participant's property (current and future), I hereby certify and declare that I will release and forever hold free and discharge from any liability Gracie Jiu-Jitsu East San Jose and each of their agents, stockholders, directors, officers, employees, independent contractors and representatives (collectively, “Gracie Jiu-Jitsu East San Jose ”) from all claims, demands, rights and causes of action of any nature whatsoever which may have or which may hereafter accrue to me, arising from and by reason of any and all bodily or personal injury, damage to property or other loss and any consequence thereof, whether known or unknown, seen or unforeseen, resulting from participant's participation in, or my application of the techniques learned in Gracie Jiu-Jitsu, their persons and entities mentioned above.

Further, knowing and understanding these risks, I hereby agree to voluntarily assume these risks to Participant and to release and hold harmless all the persons or entities mentioned above whom might otherwise be liable to me for damages. It is further understood that this waiver, release and assumption of risk is forever binding on my heirs and assigns. I also understand and acknowledge that Participant has and will maintain appropriate medical insurance during classes/training.

I authorize any emergency first aid, CPR, AEDs, medication, medical treatment, and/or emergency transportation and I assume all costs involved in such treatment.

I understand that Gracie Jiu-Jitsu East San Jose reserves the right to refuse service to any individual who has been convicted of a sex crime.

I am also aware that for purposes of safety, security and quality control, there may be surveillance cameras mounted throughout the training facility. Furthermore, because of the popularity of Gracie University, I understand and acknowledge that video or photographs may be taken of Participant and any persons in attendance during classes/training. I hereby grant Gracie Jiu-Jitsu East San Jose and any of its assignees the unlimited use of Participant's likeness in any format (video, photo, or other) for promotional, advertisement or commercial use in perpetuity, and I forfeit any form of payment for such rights.

It is further understood that filming or photography of any classes/training at Gracie Jiu-Jitsu East San Jose by any person not employed by Gracie Jiu-Jitsu East San Jose is forbidden without prior permission.

I agree that if any term of this agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, all other terms shall remain in full force and effect.

I understand that this agreement supersedes any and all previous oral or written agreements with regards to the practice of Gracie Jiu-jitsu and I give up substantial rights by signing it. My signature on this document is evidence that I know and understand what is written herein, that I fully understand the dangers that are inherent in the Activities, and that I voluntarily certify that I will not hold Gracie Jiu-Jitsu East San Jose , Gracie Global LLC, d.b.a. Gracie University, Rener Gracie, Ryron Gracie, the Gracie family, their agents, independent contractors, and/or instructors, responsible for any injury whether as a result of training or not. In addition, Participant agrees to follow the safety protocols presented to all students of Gracie Jiu-Jitsu East San Jose at the time of registration and during the training.
